CALL TO ORDER
Meeting was called to order at 7:01pm by Supervisor Peter Shrope at the Brighton Town Hall, 12 County Road 31 (aka Jones Pond Road), Paul Smiths, New York, on August 12, 2021

REPORTS

HIGHWAY – Superintendent of Highways Andy Crary: July 9, held a Rabies Clinic from 6-8pm; mowed cemeteries, Town Hall, Garage, and Park; fixed the York Rake, raked the dirt roads; cut shoulders and put gravel on shoulders of Keese Mills Road, hauled tar for Towns of Duane and Franklin; put new battery in New Holland Tractor; new Freightliner truck in Plattsburgh for an electrical problem; had sewer tanks at Garage and Town Hall pumped out; two large trucks were inspected; weed whacked the entrances to Town roads; mowed the landfill cover; fixed the door at the Park; replaced the battery in the John Deer 850 at Park; worked on Vosburgh Road, cleaned trucks, fixed a washout on Keese Mills Road; removed a tree hit by lightning at the Park.

TOWN CLERK – Elaine Sater: Total revenue to Supervisor as of July 31, 2021, was $677.75 from 1 certified copy of a Vital Record; 3 Building Permits (BP#21-027, 029 and 030), 64 copies on the copier, and 2 Notary Signatures
July 13 – Took Oath of Office for Deputy Tax Collector Linnae Hamilton.
July 19 – Sent notification and Oath of Office for Deputy Tax Collector to Franklin County Clerk
TOWN HALL REQUESTS: Monday, August 16, Rainbow Lake Water Protection District, 9am
TOWN PARK REQUEST: Tuesdays and Wednesdays, July 13 through August 11, Saranac Lake Youth Soccer (SLYS), 5:30 to 8pm and Saturday, July 24, SLYS Tournament, 10am; Saturday, August 14, Meyer Family, 10am to 8pm; and Monday, September 6, Saranac Lake Baptist Church, 12 noon to 4pm
RECORDS MANAGEMENT: Continuing to update records retention codes for Records Index and destruction documentation, finished file cabinets in Town Hall except Supervisorís files, shredding/disposing of documentation that has passed its retention period.

HISTORIAN – Elaine Sater: Nothing to Report

TAX COLLECTOR – Holly Huber: Nothing to Report
Supervisor Peter Shrope informed the Tax Collector to submit a voucher to repay a taxpayer for penalties assessed. Audit of the Tax Collector Financial Records is scheduled for September 9, at 6:25pm.

TOWN JUSTICE – Nik Santagate: Supervisor Peter Shrope received a check in the amount of $4,548.00 for 39 cases disposed during July

CODE ENFORCEMENT OFFICER – Paul Blaine: Issued 3 building permits (BP#21-027, 029 and 030), issued 1 Certificates of Compliance for BP #20-017 and 1 Certificate of Occupancy for BP#20-038. Proposed Local Law for Building Code is ready for Board discussion. It is intended to replace Local Law #1-1981 ìProviding for Unsafe Buildings and Structuresî and Local Law #2-2001 ìProviding for the Administration and Enforcement of the Uniform Fire Prevention and Building Codeî. A revised fee structure was also presented for discussion. Amber McKernan asked for clarification on current procedures. Discussion was held, only changes made were adding ìFranklin County, New Yorkî, to definition of ìTownî on Page 2 and arrangement of first three paragraphs to conform to NYS format for filing the proposed law.

RESOLUTION #37-2021
PROPOSED LOCAL LAW #2 FOR THE YEAR 2021 ìPROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF THE UNIFORM FIRE PREVENTION AND BUILDING CODEî
Motion made by Amber McKernan, second by Steve Tucker,

RESOLVED that the Town Board of the Town of Brighton, Franklin County, New York, proposes to enact Local Law #2 for the Year 2021 entitled “Providing for the Administration and Enforcement of the Uniform Fire Prevention and Building Code” to amend and replace Local Law #1-1981 “Providing for Unsafe Buildings and Structures” and Local Law #2-2001
“Providing for the Administration and Enforcement of the Uniform Fire Prevention and Building Code” and
BE IT FURTHER RESOLVED that a Public Hearing be held on Thursday, September 9, 2021 at 6pm for public comment on this proposed Local Law #2 for the Year 2021.

RESOLUTION #38-2021
UNIFORM FIRE PREVENTION AND BUILDING CODE FEES
Motion made by Supervisor Peter Shrope, second by Amber McKernan,

RESOLVED that the Town Board change the fees for Building Permits in accordance with Section 3 Paragraph ìBî of the Local Law #2 of the Year 2001 “Providing for the Administration and Enforcement of the Uniform Fire Prevention and Building Code” as follows on Page 3, Section 3:
Paragraph “A” no change
Paragraph “J” Temporary Certificate of Occupancy – $100. Good for Six (6) months. One time renewal fee $100 (one additional time only).
Paragraph “Q” Permit renewal, if renewed before expiration $30, otherwise the fee is equal to the cost of the original permit if renewed after expiration date, and
BE IT FURTHER RESOLVED that the Town Board set a fee of $100 for each municipal search request for building information by the Code Enforcement Officer.

ASSESSOR/DATA COLLECTOR – Roseanne Gallagher: Nothing to Report

SUPERVISOR – Peter Shrope:
Budget update as of July 31, 2021, was distributed to Town Board; revenue received was $658.17 from refund for propane, $23,651.63 for County Snow and Ice contract, $4,548.00 from the Town Justice, $677.75 from the Town Clerk
NYCLASS investment interest received for July as follows: $2.43 for General Fund, Balance is $111,180.80; $.93 for Highway Fund, Balance is $42,370.73
ARPA Funds: Receiving up to $144,844 from the American Rescue Plan Act (ARPA); will have to return any funds are not used for COVID-19 relief expenditures.
Charter Communications: Received notices concerning upcoming Spectrum changes dated July 19, 23, and 30, 2021.
WQIP Grant: Sent letter of support to the Town of Harrietstown concerning a Water Quality Improvement Project grant they are requesting.

Cemetery Stones Repair Proposal – Supervisor Peter Shrope: Asked Pine Haven Cemetery Services for a quote for cleaning, repairing and setting stones upright in the Mt View Cemetery. Total cost for 15 stones is $7,875.00

RESOLUTION #39-2021
REPAIR AND/OR RESET STONES IN THE MT VIEW CEMETERY
Motion made by Supervisor Peter Shrope, second by Lydia Wright,

RESOLVED that the Town Board accepts the proposal from Pine Haven Cemetery Services, Paul Smiths, to clean, repair and/or reset 15 stones in the Mt. View Cemetery for an amount Not to Exceed $7,875.00.

Home Town Hero Banners – Supervisor Peter Shrope: Received information on purchasing Home Town Hero Banners, discussion was held on who would be put on the banners and where would they be hung. Permission would be needed from National Grid to hang on electric poles. Cost per banner is $165. Tabled for further information.

Town of Franklin Open House – Supervisor Peter Shrope: Received a letter from the Town of Franklin’s Supervisor and Highway Superintendent inviting Town Officials to an Open House for their new garage on Saturday, August 14, at 11am.

Town Budget 2022 – Supervisor Peter Shrope: The Budget Officer will be sending out Budget requests on September 1 for the 2022 Budget, response is needed by September 20. The Tentative 2022 Budget meeting will be held on Thursday, October 14, before the Regular Board meeting.

Cannabis (MRTA) – Supervisor Peter Shrope: The Marihuana Regulation and Taxation Act (MRTA) allows Towns to “opt-out” with respect to Retail Dispensaries and On-site Consumption Sites. More information needed to make a determination for Town.

Osgood Pond Association – Amber McKernan: Received a letter from the Osgood Pond Association thanking the Town for supporting the Adirondack Watershed Institute training program for lake stewards. They provided some statistics for boats washed in the area.

Brighton Mini Mart – Amber McKernan: There is a sign in the window of the business in Gabriels, “Opening Soon” and hiring employees.

RESOLVED that the Supervisor be authorized to pay the audited vouchers as listed on the abstracts as follows:
PREPAID FUNDS: Abstract #8 for Voucher #s 8A thru 8D for 2021 GENERAL FUND in the amount of $433.56 and Voucher #8D for 2021 STREET LIGHTING FUNDS in the amount of $61.72
GENERAL FUND: Abstract #8 for Voucher #129 through #145 for 2021 funds in the amount of $7,759.60 HIGHWAY FUND: Abstract #8 for Voucher #66 through #73 for 2021 funds in the amount of $9,008.14
